Abstract

This article examines the legal nature, historical evolution, and distinctive characteristics of the institution of trust within the Anglo-American legal system. The study analyzes the origins and developmental stages of trust law, emphasizing its close relationship with the English judicial system and the doctrine of equity. Particular attention is devoted to the concepts of divided ownership, fiduciary duties of the trustee, and the legal status of the beneficiary. Furthermore, the article provides a comparative analysis of the trust institution in common law jurisdictions and property management mechanisms in continental legal systems, including the fiduciary patrimony under the Civil Code of Quebec. The research concludes that, despite the fundamental differences between the Anglo-American and continental legal traditions regarding property rights, the ongoing convergence of legal systems necessitates a comprehensive study of trust mechanisms and their potential application in modern civil law jurisdictions.
