Theoretical Foundations of The Rehabilitation Institute in Criminal Proceedings

Rehabilitation acquittal innocence

This article examines the theoretical foundations of the rehabilitation institution in criminal proceedings and its legal aspects. The concept of rehabilitation in criminal procedure law, its process and mechanisms are also analyzed. In accordance with the Criminal Procedure Code of the Republic of Uzbekistan, the implementation of rehabilitation ensures the restoration of a person's rights, compensation for harm, and social reintegration. Although it is generally recognized that the main feature of legal rehabilitation is acknowledging the return of a person to their previous state before they were unlawfully, unreasonably, or unjustly subjected to (disciplinary, civil, administrative, or criminal) liability by the state and on its behalf, rehabilitation in criminal proceedings remains one of the most controversial issues among procedural scholars and practicing specialists. There are various views and approaches regarding legal rehabilitation and its constituent elements. Based on the analysis results, recommendations are provided on addressing existing problems in interpreting the essence of acquittal and the concept of rehabilitation using modern scientific approaches.

Before the introduction of amendments and additions to the Criminal Procedure Code by the Law of the Republic of Uzbekistan dated September 27, 2023 No. ЗРУ-869, it was possible to express a firm opinion that, in accordance with criminal procedure legislation, higher courts may issue rulings or decisions equivalent to acquittals. According to these changes, all higher courts were granted the authority to issue acquittals. By highlighting this type of rehabilitation documentation, rulings and decrees of higher courts issued before these changes are also provided.
